Judge delays revising sex abuse sentence

LE MARS, Iowa -- A judge ruled that a Northwest Iowa man trying to get his sex abuse sentence reconsidered will have to wait until the court approves a treatment plan.
Mark Bogenrief, 58, of Sutherland, was sentenced earlier this year to up to 10 years in prison after pleading guilty to third-degree sexual abuse. His attorney had asked the court consider letting his client out on probation, in accordance with Iowa's shock sentencing.
Shock sentencing allows judges to reconsider a defendant's sentence a few months after they are sentenced to prison.
District Court Judge Edward A. Jacobson on Thursday issued a court order saying although Catholic Charities of Sioux City had been asked on March 28 to provide a treatment plan for Bogenrief, it instead provided a report of things that needed to be done in order to create that plan.
Jacobson's order stated the court will not reconsider Bogenrief's sentence until it has a proposed treatment plan and "Mr. Bogenrief's assurances that he will, in fact, complete the plan if ordered by the court."
Bogenrief was arrested in 2005, after a then-25-year-old woman reported Bogenrief had sexually abused her when she was in her teens.
