MITCHELL, S.D. (AP) -- A Fort Thompson man charged with his brother's death said his brother attacked him first, according to statements from two witnesses.
Dustin Cheyenne Crowe, 24, bled to death March 8 after sustaining a cut to the neck that severed his jugular vein. His brother, Torin Forrest Crowe, has pleaded not guilty to second-degree murder.
Brian James Sargent and Kyle Ray Merritt told investigators that Torin Crowe said his brother came at him with a knife. The account was part of an affidavit filed by an FBI agent.
Sargent and Merritt said Torin Crowe's statements were made while they were sharing a jail cell in Lower Brule.
According to court records, the Crowe brothers and two others were in a vehicle near Fort Thompson when the brothers started arguing, got out and fought.
Torin Crowe is scheduled to stand trial July 29 in Pierre.
