Colorado cell phone company sues Nebraska county

Posted: Thursday, June 12, 2008
OMAHA, Neb. (AP) -- A Colorado cellular company is suing Saunders County in eastern Nebraska, seeking to force county officials to let it build a cell tower there.

The lawsuit filed Tuesday in U.S. District Court in Omaha by Viaero (Vee-AIR-Oh) Wireless seeks injunctive relief to build the tower, as well as unspecified damages and attorneys fees.

Viaero wants to build the tower to provide wireless services in Mead, Yutan and surrounding areas just southwest of Omaha.

Viaero Wireless operates throughout rural areas of Nebraska and Colorado.

In its lawsuit, Viaero says the Saunders County board violated the federal Telecommunications Act, among other things, by denying Viaero a permit last year to build the tower.
