Colman slaying was justifiable homicide, no charges filed

SIOUX FALLS, S.D. (AP) -- Moody County authorities will not charge a rural Colman man for shooting to death another man because it was ruled justifiable homicide.
Matthew Heinricy shot Jason Clough of Marshall, Minn., after Clough fired a shotgun at Heinricy's house and tried to get inside, where his ex-wife and child were staying.
A statement from the sheriff's office says a grand jury investigated the case and decided not to issue any indictments.
A temporary protection order filed in March required Clough to stay at least 300 feet away from his wife, Jessica, and their child. A permanent order was issued in April.
Jessica Clough said in court documents that her husband was a threat to her and their child.
