Businesses drop Omaha smoking ban challenge

OMAHA, Neb. (AP) -- An Omaha judge has been asked to dismiss a challenge to the city's public smoking ban, although another challenge remains.
Horsemen's Park, Big Red Keno and others objected to the state Supreme Court's May ruling that abolished exemptions to the ban.
Greg Hosch, general manager of Horsemen's Park, said they had hoped a Douglas County District Court judge would consider their objection before issuing a final order eliminating the exemptions. He said they've lost busineses since they were forced to stop allowing smoking last month.
Big John's Billiards has asked for a temporary restraining order and a permanent injunction halting enforcement of the law. A hearing was set for Tuesday.
A statewide smoking ban goes into effect next year.
