State challenges suspended fraternity ruling

DES MOINES, Iowa (AP) -- The attorney general's office has asked the Iowa Supreme Court to overturn a decision involving an alleged illegal recording used to suspend a fraternity.
Last year, a district court judge ordered the state, the University of Iowa and the school's vice president to pay more than $164,000 in damages and legal fees to Phi Delta Theta fraternity for violating state law.
The Iowa attorney general's office is challenging that decision, arguing that the inactive fraternity didn't have standing to bring the civil action.
The district court ruling says the tape recording, used to substantiate allegations of hazing, should not have been used by the university in 2002 to suspend the fraternity. The judge found that the tape was made illegally by a former pledge.
The Supreme Court is expected to rule on the case later this year.
