PIERRE, S.D. (AP) -- A 24-year-old Pierre man accused in a child molestation case involving a 4-year-old has been granted supervised release.
Circuit Judge John Brown agreed with a defense request to release Josia Fuerst (FIRST) while his case is in court. The judge says Fuerst must remain in the homes of Pamela Bartlett and Doug Runge and be accompanied by at least one of them whenever outdoors. He is to have no contact with anyone under 16.
Prosecutors objected, saying Fuerst is a risk to all children.
Fuerst has pleaded not guilty by reason of insanity to one count of first-degree rape and five counts of sexual contact with a person under 16.
Prosecutors say the 4-year-old attended a daycare run by Fuerst's mother.
His next court date is Nov. 5.
