Spirit Lake School trial delayed

SPIRIT LAKE, Iowa -- A trial scheduled for Tuesday in Dickinson County District Court seeking the dismissal of two Spirit Lake school board members was suspended after consultations in the judge’s chambers.
Peter Hart, attorney for the plaintiffs, said the court determined the alleged open meetings violations, originally targeted only toward school board president Beth Will and vice president Ann Goerss, are to be recast to include all five members sitting on the board at the time of the alleged violations. The closed sessions in question are Nov. 15, 2007; Jan. 9, 2008; Feb. 5, 2008, and Feb. 11, 2008.
This new procedural development is in exchange for the petitioners dropping their efforts to try to remove Will and Goerss from office, according to Steve Avery, attorney for the Spirit Lake School District.
The case against Wills and Goerss was brought last winter in the wake of the controversial resignation of Spirit Lake High School Principal Jedd Sherman. A judge will hear the case on the alleged open meetings violations Oct. 21 in Dickinson County District Court.
