Trial scheduled for bar owner's suit against city, police

SIOUX CITY -- A federal civil lawsuit pitting a Fourth Street bar owner against the city of Sioux City is scheduled to go to trial in January.
In August, Tom Foolery's Pub & Grill owner Tim Shannon filed suit against the Sioux City Police Department, police officer Michael Koehler, Sioux City Police Chief Joe Frisbie and the City of Sioux City.
This week, a judge scheduled the trial for Jan. 11 in U.S. District Court in Sioux City.
Shannon alleges in the lawsuit that his civil rights were violated when Koehler, a former Journal reporter, assaulted him while responding to a call Sept. 13, 2006 at Tom Foolery's.
In a response, Koehler and the city denied the claim.
The Sioux City Police Department was dropped from the lawsuit last month after a judge determined it was part of the City of Sioux City and not a separate legal entity.
